Family Trusts

A Family Trust can provide you with extra peace of mind that your loved ones will get the most out of your assets when you are no longer there to take care of them. It can be a more secure way to pass on your wealth opposed to doing it via a Will or gifts.

Our team can assist you by setting up a Family Trust, ensuring your wishes are followed and  your assets are protected.

There are three parties in a Trust:

  1. Grantor (Individual setting up the Trust)
  2. Trustees (Those who will manage and administer the Trust)
  3. Beneficiaries (Those who will benefit from the Trust)

Some of the benefits of a Family Trust:

  • Reduce the tax your spouse will be left with when you die.
  • Ensure family members assets are protected when they are unable to do so for themselves.
  • Reduce inheritance tax bills.
  • Ensure your family are financially looked after whilst still being tax efficient.
  • Ensure assets are protected if your spouse divorces you.
  • Clear outline of how your assets should be split when you die.
  • Avoid or reduce Probate.

Types of Family Trust Funds

Irrevocable Family Trust

An irrevocable Family Trust, is one that is not easily changed or canclled once it has been created.

Once the Trust is made the Grantor will no longer have control or access to the assets because they will be at that point, Trust-owned.

Living Trust

A Living Trust is used whilst you are still alive and contains all of your assets.

It will also provide details on your exact wishes for what must happen to your assets once you die.

Revocable Family Trust

Revocable Family Trusts, as the name suggested can be dissolved or changed at any time by the Grantor.

Marital Trust

A Marital Trust will provide that upon death, all of your assets will pass to the surviving spouse.

When the surviving spouse dies, the Trust will pass to named beneficiaries.
