Unpaid invoices and money owed generally, can be a real headache have a significant impact on your daily life and/or business. Having expert advice on the most cost effective and timely solution available to you can help you quickly recover monies owed in order for you to continue with your life.

In the first instance our team will agree a fixed fee to review your case, starting at £100 +VAT in which we will take you through your case assessing the strengths and weaknesses of your case, and writing a letter the debtor that is compliant with the relevant pre-action protocol.

Hopefully, a strongly worded legal letter will be sufficient to have the debtor settle the outstanding amount, however this is unfortunately not always the case. If this turns out to be the case the matter may need to proceed via the Courts.

If it becomes necessary to issue proceedings for recovery of an undisputed debt, the following Court fees will apply:

It is important to note that when you pursue a claim interest and compensation may take the debt into a higher banding, which means that a higher Court fee may be payable. The process generally speaking is as follows:

  • We will charge between £300 and £500 (excluding VAT) to draft simple short-form Court proceedings claiming payment of an undisputed invoice.
  • If the other party fails to acknowledge service of the proceedings or fails to file a defence to the claim, we will charge £150 (excluding VAT) to request a default judgment and, on receipt of the default judgment, to write to the other party again, demanding payment.

A default judgment will only include Court fees and fixed solicitor’s costs. Please note that you will not be able to recover the fees that you pay us. However, you will be able to recover some of them.

If the other party does not pay the amount ordered by the Court, we will write to you advising on the various methods available to you in recovering your debt by court enforcement. These include – attachment of earnings, charging orders, bailiff / high court enforcement. The charges for our services set out above do not include the cost of any further steps that may be required to enforce the judgement; however we will work with you to find the most cost effective and robust solution.

If the Defendant defends the claim and the matter becomes contested, we will discuss the costs of our services moving forwards and set out the steps that will occur in a separate letter.
