Applications to the Criminal Cases Review Commission
The Criminal Cases Review Commission is the independent body which looks into miscarriages of justice . Generally you can make an application if you have already appealed sentence or conviction and been refused.
However there are exceptional grounds under which the commission can also accept a case if you haven't appealed before.
The Commission apply a test in conviction reviews which is set out in the Criminal Appeal Act 1995 which specifies the Commission can only refer a case if they consider that if they refer your case there is a reasonable possibility the Court of Appeal will not uphold the conviction i.e they will quash your conviction.
We specialise in CCRC Applications and have undertaken a number of significant CCRC Referrals where we have investigated cases which previously had been refused by the Court of Appeal or even the CCRC.
As a result we can offer you assistance in investigating a miscarriage of justice. We offer public funding if we assess that your case meets the Legal Aid Agency sufficient benefit test , which is an assessment whether you have prospects of appealing sufficient enough to justify spending public funds upon.
There is also a means test you would have to meet to qualify for legal aid.
For those who do not qualify we can offer private funding either on a fixed fee basis or for more complex cases we can work on hourly rates and quotes on the amount of work needed for detailed investigations.
